The City has received a development variance permit application for 6900 Burnaby Street. This application is seeking to relax the required sidewalk width from 1.65m to 1.5m, and the requirement to provide a minimum 1m clear space around a fire hydrant by allowing a gate within this clear space minimum. If the variance is approved, it would support the issuance of an occupancy permit for the third phase of the multi-unit residential development.
The three multi-unit residential buildings at 6900 Burnaby Street were built as a phased stratified development over the last three decades. Phase 1 was completed in 1995; Phase 2 was completed in 2021; and now Phase 3 is nearing completion. Final occupancy for Phase 3 is being withheld until all project requirements are met. One area that requires approval from Council before occupancy can be granted is related to some of the works and services required as per City of Powell River Infrastructure Design and Construction Bylaw 2225, 2009 (Bylaw 2225).
Some of the works and services were already installed, and due to errors made during construction, a development variance permit is now required. The first error was the construction of a narrower sidewalk than the bylaw requirement. City staff, in accordance with Bylaw 2225, had approved the proposed sidewalk width of 1.65m, instead the developer incorrectly built a 1.5m wide sidewalk.
The second error relates to the required clear space around a fire hydrant. Bylaw 2225 requires works and services to be designed and constructed in compliance with the Master Municipal Construction Document (MMCD). MMCD standards require that a minimum 1.0m clear space is required around a hydrant. The developer has installed a hydrant with limited clearance around it due to adjacent fencing. Rather than remove the fencing within the required clear space minimum, the developer has proposed to install swinging gates that can be opened to create the required 1.0m separation from the hydrant.
Council will consider granting approval for issuance of Development Variance Permit 289 at its May 8, 2025, regular meeting. Anyone who feels they may be affected by the proposed variance can make written submission to Mayor and Council. Submissions may be emailed to planningservices@powellriver.ca, mailed to City Hall, 6910 Duncan Street, Powell River, BC, V8A 1V4, or delivered in person to City Hall. All written submissions must be received no later than 2 pm on May 8, 2025.
